1. Agreement to Terms

Welcome to Trackwallet ("App," "we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Augustinas Abromavičius, the independent developer of Trackwallet, located in Lithuania.

By downloading, installing, accessing, or using Trackwallet, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

2. License to Use the App

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Trackwallet on your personal Android device(s) solely for your personal, non-commercial purposes.

2.2 License Restrictions

You agree NOT to:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the App
• Rent, lease, lend, sell, sublicense, distribute, or transfer the App to any third party
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App, its servers, or related systems
• Interfere with or disrupt the App's functionality or servers
• Use any automated means (bots, scripts, etc.) to access or interact with the App

2.3 Intellectual Property Rights

The App, including all source code, databases, functionality, software, designs, graphics, text, photographs, and other content (collectively, "Content"), and all intellectual property rights therein, are owned by Augustinas Abromavičius and are protected by copyright, trademark, and other intellectual property laws.

The Trackwallet name, logo, and all related names, logos, product and service names, designs, and slogans are proprietary marks. You may not use such marks without our prior written permission.

3. User Accounts

3.1 Account Creation

Creating an account is optional. You may use the App without an account, but certain features (such as cloud backup) require account registration. When creating an account, you must provide accurate and complete information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time through the App settings or by contacting us at contact@trackwallet.app. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Premium Features and Subscriptions

4.1 Premium Version

Trackwallet offers a free version with basic features and a premium version that unlocks additional functionality, including but not limited to:

• Cloud backup and restore
• Live currency exchange rates
• Multiple account support
• Additional features as updated from time to time

4.2 Pricing and Payment

Premium features can be unlocked through:

• Lifetime Purchase: One-time payment for permanent access
• Monthly Subscription: Recurring monthly payment
• Annual Subscription: Recurring annual payment

Prices vary by region and are displayed in your local currency within the App. All payments are processed securely through Google Play Billing. By purchasing premium features, you agree to the pricing and payment terms presented at the time of purchase.

No free trial is offered for premium features. You will be charged immediately upon purchase.

4.3 Subscription Terms

If you purchase a subscription:

• Your subscription automatically renews at the end of each billing period unless you cancel
• You will be charged the then-current rate for your subscription plan
• You can cancel your subscription at any time through your Google Play account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods upon cancellation

4.4 Purchase Restoration

Premium purchases made through Google Play are tied to the Google account used at the time of purchase. To restore your premium purchase on another device:

1. Ensure you are logged into the same Google account used for the purchase
2. Reinstall the App from Google Play
3. Your premium features should automatically restore

If restoration does not work:

• Uninstall the App from your device
• Open the Google Play Store in a web browser
• Verify you are logged into the correct Google account
• Download and install the App from the web version of Google Play

4.5 Changes to Premium Features

We reserve the right to modify, add, or remove premium features at any time. We will make reasonable efforts to notify users of significant changes. Continued use of premium features after such changes constitutes acceptance of the modifications.

5. Refund Policy

We want you to be satisfied with your purchase. Our refund policy is as follows:

5.1 Eligibility

Refunds may be issued under the following conditions:

• The refund request is made within 7 days of the purchase date
• You are dissatisfied with the premium features or have a valid reason for requesting a refund
• The purchase was made in error or due to technical issues

5.2 Refund Process

To request a refund:

1. Contact us at contact@trackwallet.app within 7 days of purchase
2. Include your order details and reason for the refund request
3. We will review your request and respond within 3-5 business days

Refunds are issued directly by us, not through Google Play, and will be processed to the original payment method. Please allow 5-10 business days for refunds to appear in your account.

5.3 Non-Refundable Circumstances

Refunds will not be issued:

• After 7 days from the date of purchase
• For subscription renewals (please cancel before the renewal date)
• If you have violated these Terms of Service
• For purchases made through unauthorized channels

6. User Content and Data

6.1 Your Data

You retain all rights to the financial data and information you enter into the App ("User Data"). You are solely responsible for the accuracy, completeness, and legality of your User Data.

6.2 Data Storage and Backup

By default, your data is stored locally on your device. If you choose to use the optional cloud backup feature (premium only), you authorize us to store your data on Firebase Storage for backup and restoration purposes.

6.3 Data Responsibility

While we implement reasonable security measures, you acknowledge that:

• You are responsible for maintaining your own backups of important data
• We are not responsible for any loss, corruption, or unauthorized access to your User Data
• Cloud backup is a convenience feature and should not be your sole backup method
• We do not verify the accuracy or validity of User Data you enter

7. Third-Party Services

Trackwallet integrates with the following third-party services, each governed by their own terms of service:

• Firebase Storage: Terms of Service
• Firebase Services: Terms of Service

By using Trackwallet, you acknowledge and agree to be bound by the terms and privacy policies of these third-party services. We are not responsible for the practices, policies, or content of third-party services.

We do not endorse or assume responsibility for any third-party services. Your use of such services is at your own risk.

8. Disclaimers and Limitations of Liability

8.1 No Financial Advice

Trackwallet is a financial tracking and budgeting tool only. The App does not provide financial, investment, tax, or legal advice. All information and features in the App are for informational and organizational purposes only.

You should not rely on the App for financial decisions. Always consult with qualified financial advisors, tax professionals, or legal counsel before making any financial, investment, or legal decisions.

8.2 Accuracy of Information

We strive to provide accurate functionality, but we do not warrant that:

• The App will be error-free, uninterrupted, or secure
• Currency exchange rates or other data will be accurate or up-to-date
• Calculations or reports generated by the App will be error-free
• The App will meet your specific requirements

8.3 "AS IS" Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRACKWALLET, AUGUSTINAS ABROMAVIČIUS, OR ANY AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Financial losses due to inaccurate data or calculations
• Data loss, corruption, or unauthorized access
• Business interruption or opportunity costs
• Any other damages arising from your use or inability to use the App

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PREMIUM FEATURES IN THE 12 MONTHS PRECEDING THE CLAIM, OR €50 (FIFTY EUROS), WHICHEVER IS GREATER.

8.5 Indemnification

You agree to indemnify, defend, and hold harmless Trackwallet, Augustinas Abromavičius, and our affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

9. Termination

9.1 Termination by You

You may stop using the App at any time by uninstalling it from your device and deleting your account (if created).

9.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of App features or services
• Extended period of inactivity

9.3 Effect of Termination

Upon termination, your right to use the App immediately ceases. You must uninstall the App from all devices. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will continue to apply.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Lithuania. However, we encourage you to contact us first at contact@trackwallet.app to attempt to resolve any disputes amicably.

10.3 EU Consumer Rights

If you are a consumer residing in the European Union, you may also have the right to bring disputes to the attention of your local consumer protection authorities or use online dispute resolution platforms provided by the European Commission.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trackwallet regarding your use of the App and supersede all prior agreements and understandings.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

11.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Trackwallet.

11.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, internet failures, or government restrictions.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page.

We do not have an automatic notification mechanism for Terms changes. We encourage you to review these Terms periodically by visiting this page. Your continued use of the App following any changes constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the App and uninstall it from your device.
