Terms of Service

1. Agreement to Terms

Welcome to Trackwallet ("App," "we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Augustinas Abromavičius, the independent developer of Trackwallet, located in Lithuania, European Union.

By downloading, installing, accessing, or using Trackwallet on any platform — including Android and iOS — you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

2. License to Use the App

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Trackwallet on your personal Android or iOS device(s) solely for your personal, non-commercial purposes.

2.2 License Restrictions

You agree NOT to:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the App
• Rent, lease, lend, sell, sublicense, distribute, or transfer the App to any third party
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorised access to the App, its servers, or related systems
• Interfere with or disrupt the App's functionality or servers
• Use any automated means (bots, scripts, etc.) to access or interact with the App

2.3 Intellectual Property Rights

The App, including all source code, databases, functionality, software, designs, graphics, text, photographs, and other content (collectively, "Content"), and all intellectual property rights therein, are owned by Augustinas Abromavičius and are protected by copyright, trademark, and other intellectual property laws.

The Trackwallet name, logo, and all related names, logos, product and service names, designs, and slogans are proprietary marks. You may not use such marks without our prior written permission.

3. User Accounts

3.1 Account Creation

Creating an account is optional. You may use the App fully offline without one. Certain features, such as cloud backup, require account registration. When creating an account, you must provide accurate and complete information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately of any unauthorised use at contact@trackwallet.app.

3.3 Account Deletion

You may delete your account at any time through the App settings or by contacting us at contact@trackwallet.app. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Premium Features and Subscriptions

4.1 Premium Version

Trackwallet offers a free version with core features and a premium version that unlocks additional functionality, including but not limited to:

• Cloud backup and restore
• Live currency exchange rates
• Multiple account support
• Additional features as updated from time to time

4.2 Pricing and Payment

Premium access can be unlocked through:

• Lifetime Purchase: A one-time payment for permanent premium access, available on both Android and iOS
• Monthly Subscription: A recurring monthly payment that auto-renews
• Annual Subscription: A recurring yearly payment that auto-renews

Prices vary by region and are displayed in your local currency within the App before purchase. All payments are processed securely through the platform you are purchasing on — Google Play Billing on Android, or the Apple App Store on iOS. By completing a purchase, you agree to the pricing and payment terms presented at the time of purchase.

No free trial is offered. You will be charged immediately upon completing a purchase.

4.3 Subscription Auto-Renewal

If you purchase a monthly or annual subscription:

• Your subscription automatically renews at the end of each billing period unless cancelled beforehand
• You will be charged the then-current rate for your plan at renewal
• You can cancel at any time through your platform's subscription settings:
  • Android: Google Play → Subscriptions → Trackwallet → Cancel
  • iOS: Settings → Apple ID → Subscriptions → Trackwallet → Cancel
• Cancellation takes effect at the end of the current billing period — you retain access until then

4.4 Restoring Purchases

Premium purchases are tied to the store account used at the time of purchase (Google account on Android, Apple ID on iOS). To restore your purchase on a new device, sign in with the same account and use the "Restore Purchases" option within the App. If restoration fails, contact us at contact@trackwallet.app.

4.5 Changes to Premium Features

We reserve the right to modify, add, or remove premium features at any time. We will make reasonable efforts to notify users of significant changes. Continued use of premium features after such changes constitutes acceptance of the modifications.

5. Refunds

All purchases made through the App are processed by the respective app store platform — Google Play on Android, or the Apple App Store on iOS. Refunds are governed by the refund policies of those platforms:

• Android: Refund requests are handled by Google Play. Visit Google Play's refund policy for details.
• iOS: Refund requests are handled by Apple. Visit Apple's refund policy for details.

We do not process refunds directly. If you have a billing issue or believe a charge was made in error, please contact us at contact@trackwallet.app and we will do our best to assist.

6. User Data

6.1 Your Data

You retain all rights to the financial data and information you enter into the App ("User Data"). You are solely responsible for the accuracy, completeness, and legality of your User Data.

6.2 Local and Cloud Storage

By default, all your data is stored locally on your device. If you choose to use the optional cloud backup feature, you authorise us to store your data on Firebase Storage for backup and restoration purposes. This applies equally on Android and iOS.

6.3 Data Responsibility

While we implement reasonable security measures, you acknowledge that:

• You are responsible for maintaining your own backups of important data
• We are not responsible for any loss, corruption, or unauthorised access to your User Data
• Cloud backup is a convenience feature and should not be your sole backup method
• We do not verify the accuracy or validity of User Data you enter

7. Third-Party Services

Trackwallet integrates with the following third-party services, each governed by their own terms:

• Firebase (Google) — Authentication, Crashlytics, Storage: Terms of Service
• RevenueCat — Subscription management: Terms of Service
• Google Play Billing (Android only): Terms of Service
• Apple App Store / StoreKit (iOS only): Terms of Service

By using Trackwallet, you acknowledge and agree to be bound by the applicable terms of these third-party services. We are not responsible for the practices, policies, or content of any third-party service.

8. Disclaimers and Limitations of Liability

8.1 No Financial Advice

Trackwallet is a financial tracking and budgeting tool only. The App does not provide financial, investment, tax, or legal advice. All features and information in the App are for informational and organisational purposes only. Always consult qualified professionals before making financial decisions.

8.2 Accuracy

We do not warrant that:

• The App will be error-free, uninterrupted, or secure
• Currency exchange rates or other data will be accurate or up-to-date
• Calculations or reports generated by the App will be error-free
• The App will meet your specific requirements

8.3 "AS IS" Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRACKWALLET OR AUGUSTINAS ABROMAVIČIUS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, FINANCIAL LOSSES, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PREMIUM FEATURES IN THE 12 MONTHS PRECEDING THE CLAIM, OR €50 (FIFTY EUROS), WHICHEVER IS GREATER.

8.5 Indemnification

You agree to indemnify and hold harmless Trackwallet and Augustinas Abromavičius from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

9. Termination

9.1 Termination by You

You may stop using the App at any time by uninstalling it from your device and deleting your account (if you have one).

9.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, including for violation of these Terms, fraudulent or illegal activity, or abuse of App features.

9.3 Effect of Termination

Upon termination, your right to use the App immediately ceases. Sections that by their nature should survive termination — including disclaimers, limitations of liability, and governing law — will continue to apply.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Lithuania. We encourage you to contact us first at contact@trackwallet.app to resolve any issues amicably.

10.3 EU Consumer Rights

If you are a consumer residing in the European Union, you may also have the right to bring disputes to your local consumer protection authorities or use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trackwallet regarding your use of the App.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

11.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

11.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, natural disasters, internet failures, or government restrictions.

12. Changes to These Terms

We may update these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. For changes that materially affect your rights, we will make reasonable efforts to notify you through the App.

Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the App.
